Side By Side Sites: Website Service Agreement

Client (“you”): the business named in your signed agreement with us.

These terms apply to every website build and hosting plan we sell. Your signed agreement lists your business details, your website, the preview link you reviewed, and the plan you chose.

Order summary (read this first)

Website build, including the first month of hosting: $499 one time, charged today when you sign and pay.

Hosting, updates and support plan. Your signed agreement shows which plan you chose. Every plan includes the same service (section 5). Billing starts 30 days after today.

When a prepaid term ends, the plan continues at $99/month unless you cancel or renew.

By signing or by accepting these terms at checkout, you confirm all of the following:

1. You’ve seen the preview of your website at the link in your signed agreement before paying.
2. You authorize us to charge the card or bank account you give us $499 today and the plan price you chose above starting 30 days after your first payment, as described in section 6.
3. On the month-to-month plan, you can cancel anytime by email. A prepaid plan covers its full term and isn’t refunded if you cancel early (section 7).
4. All payments are final. We do not give refunds of any kind, for the build fee, monthly payments or prepaid plans (section 8).
5. If you have a problem with a charge, you’ll contact us first and give us 10 days to fix it (section 9).

1. What we’ll build (scope)

We’ll build and launch a website for your business based on the preview you reviewed. Included:

• Up to 5 pages (for example: Home, Services, About, Gallery, Contact), matching the preview’s design.
• Mobile-friendly layout, contact/quote form or click-to-call button, Google Maps location, and links to your social pages.
• Basic on-page search setup (page titles, descriptions, Google Business link).
• Connecting your domain name and an SSL certificate (the padlock).

Not included unless we agree in writing for an extra fee: online stores or payment processing, booking systems, extra pages, logo design, professional photography, copywriting beyond the preview, paid advertising, and guaranteed search rankings.

2. What we need from you

You’ll send us any content you want changed (photos, text, hours, services, pricing) within 14 days of signing. You confirm you own or have permission to use everything you send us. If we’re waiting on you for more than 30 days, we may launch the site as shown in the preview.

3. Revisions

Before launch, you get 2 rounds of revisions. A round is one list of changes sent together. More rounds, or changes that go beyond the scope in section 1, are billed at $50 per hour and we’ll tell you the cost before doing the work.

4. Approval and launch

When the site is ready we’ll email you a final link. You’ll reply to approve it, or send your revision list. If you don’t respond within 7 days, or if you start using the live site, the site counts as approved and delivered. Launch (the site going live at your domain) means the build is complete and the $499 build fee is earned in full.

5. What the hosting plan covers

• Hosting, security updates, backups and SSL.
• Small content updates, up to 1 hour per month (for example: hours, prices, photos, a new service). Unused time doesn’t roll over.
• Email support, usually answered within 2 business days.

Bigger changes (redesigns, new pages, new features) are quoted separately.

6. Recurring billing authorization

You authorize Side By Side Sites, through our payment processor Stripe, to charge your payment method for the plan you chose, starting 30 days after your first payment:

• Month to month: $99 every month until you cancel.
• Prepaid 6, 12 or 24 months: the full prepaid price once, on that date. When your prepaid term ends, your plan continues month to month at $99 per month unless you cancel or buy another prepaid term. We’ll email you a reminder at least 30 days before your prepaid term ends.

We’ll email a receipt for every charge. If a payment fails, we’ll try again and email you. If it’s still unpaid after 14 days, we may pause your site until the balance is paid. We’ll give you at least 30 days’ notice by email before any price change. We do not accept PayPal; all payments are made through Stripe.

7. Cancelling

Month to month: you may cancel at any time by emailing aidan@sidebysidesites.com. Cancellation takes effect at the end of the month you’ve already paid for, and you won’t be charged again. To avoid the next charge, cancel at least 3 days before your next billing date. We don’t give partial-month refunds. We’ll confirm your cancellation in writing.

Prepaid plans: you’re paying in advance for the full term at a discount. You can cancel at any time, and your site stays live until the prepaid term ends, but no part of a prepaid plan is refunded, credited or transferred if you cancel early. To stop the $99 monthly billing that follows a prepaid term, cancel at least 3 days before the term ends.

Switching plans: you can move from month to month to a prepaid plan at any time; the prepaid term starts on your next billing date.

8. No refunds

All sales are final. We do not give refunds of any kind, whether for the $499 build fee, any monthly payment, any prepaid plan or unused part of one, or any partial month, and whether or not you use the website. You’ve seen the preview of your site before paying, so you know what you’re buying. If you’re unhappy with something, tell us and we’ll work with you to fix it under sections 3 and 5. Cancelling (section 7) stops future charges but does not refund past ones.

9. Billing disputes

If you think a charge is wrong, please email us first. You agree to give us 10 business days to look into it and fix it before you dispute the charge with your bank or card company. If you dispute a charge for services we delivered as described in this agreement, we’ll share this agreement, your approval, and our records with your bank, and you’ll remain responsible for the amount owed plus reasonable costs of collecting it.

10. Ownership

• Before you pay: the preview site is view-only and belongs to Side By Side Sites. You may not copy or use its design, code or text until you’ve signed this agreement and paid.
• Your content is yours: your business name, logo, photos, text and your domain name always belong to you.
• Your domain: registered in your name. We register and renew it for you, and the yearly cost is included in your hosting plan while it’s active. If you cancel, it stays yours and we’ll transfer it to you on request.
• The website design and code are licensed to you for as long as you’re on a hosting plan (monthly or prepaid).
• If you cancel: your site comes down at the end of your last paid month. We’ll send you a copy of your content on request. If you’d like to keep the full website files and move them to another host, you can buy them for a one-time fee of $199.
• We may show your site in our portfolio unless you tell us not to.

11. Uptime and responsibility

We aim to keep your site online at all times but can’t promise 100% uptime, since we rely on hosting providers. Our total liability under this agreement is limited to the amount you paid us in the 3 months before the claim. We’re not responsible for lost profits or indirect damages.

12. Ending the agreement

Either side can end this agreement in writing. We may end it if you don’t pay, or if you ask us to publish content that is illegal, infringing or misleading. Sections 8 to 13 still apply after the agreement ends.

13. Legal stuff

• This agreement is governed by New Jersey law. Any dispute will be handled in the state courts of Morris County, New Jersey, including small claims (Special Civil Part) where it qualifies.
• This is the entire agreement between us. Changes must be in writing (email counts) and agreed by both sides.
• If any part is found unenforceable, the rest still applies.
• You confirm you’re authorized to sign for the business, and that you’re buying for business purposes.
• Electronic signatures, checkbox acceptance and email approvals are as binding as handwritten signatures.
